Terms of Service

1. Agreement

These Terms govern your use of the Tokenality marketing site and the Tokenality gateway product operated by ServiceVision ("Tokenality", "we"). By accessing the service you agree to these Terms. If you are using the service on behalf of an organization, you represent that you are authorized to bind it.

2. Design-partner phase

Tokenality is currently offered by invitation to design partners during a stealth phase. Where you and Tokenality have signed a separate design-partner or order agreement, that agreement governs and controls over any conflicting term here. Features, pricing, and availability may change during this phase.

3. The service

Tokenality is a governance gateway that proxies your LLM API calls, applies the budget, policy, and PII controls you configure, and records attributed usage. You are responsible for the prompts you send, the keys and budgets you configure, and your end users' use of the service.

4. Acceptable use

You will not use the service to violate law, infringe rights, transmit malware, or attempt to circumvent its security, isolation, or rate controls. You will comply with the usage policies of any downstream LLM provider you route through the gateway.

5. Your data and keys

You retain all rights to the prompts, responses, and data you process through the service. We process that data only to provide the service, as described in our Privacy Policy. Provider API keys you store are encrypted at rest and bound to your organization.

6. Availability & warranty

During the design-partner phase the service is provided "as is" and "as available," without warranties of any kind, express or implied. We do not warrant uninterrupted or error-free operation. Current status is published at /status.

7. Limitation of liability

To the maximum extent permitted by law, Tokenality will not be liable for indirect, incidental, special, or consequential damages, or for lost profits or data. Our aggregate liability arising from the service is limited to the amounts you paid us in the three months preceding the claim (or, during a no-fee design-partner engagement, to US $100).

8. Intellectual property

Tokenality and its underlying software, other than components we make available under a separate open-source or source-available license, remain our property. We grant you a limited, non-exclusive, non-transferable right to use the service under these Terms.

9. Termination

Either party may end a design-partner engagement at any time. On termination your right to use the service stops; we will delete or return your data as described in the Privacy Policy.

10. Changes & governing law

We may update these Terms; material changes will be posted here with a new date and, for active customers, notified by email. These Terms are governed by the laws of the United States and the State of Washington, without regard to conflict-of-laws rules.
